General conditions of sale
1.    Purpose

The following general sale conditions have for purpose on the one hand to inform any consumer on the terms and the methods in which the seller carries out the sale and the delivery of the ordered products; then on the other hand to define the rights and obligations of the parties in connection with the sale of goods by the seller to the customer.
These conditions apply to all sales of the products on the website : www.azurproj.com by Azur Technique Projection firm without limitation or qualification.
According to this, anyone who orders a product sold on the Azur Technique Projection’s website agrees on the general sales conditions which the purchaser acknowledges having read prior to its command.
The goods are offered for sale on the following geographical territories : metropolitan France, Corsica. For the French overseas departments and territories contact us.
Prior to its command the purchaser claims to have full legal capacity to allow him to commit to the general terms of sale.
The Azur Technique Projection’s firm reserves the right to change the general terms of sale at anytime.

3.    Access to the website

The purchaser is responsible of any means used to access to the ATP’s website. He is responsible of the web costs.

4.    Agreement and orders

4.1    Price
 
The selling price (in euros) of the products online on the ATP’s website are those in effect at the time of registration of the purchase order by the buyer. They do not include shipping charges, invoiced following the order amount. Shipping costs will be shown before the registration of the command by the buyer. Except voluminous package or special weight in this case contact us. The prices do not include the VAT which will be applicable on the day of the command, and any change in the VAT rate will be automatically passed on to the prices of products sold by ATP within its website. The selling prices of the products can be modified by ATP at any time. This change will be reported to the buyer before any order.

4.2    The product features – Availability -  Shipping

In accordance with the section L 111-1 of the Consumer Code, the buyer can prior to his order take note on the ATP’s site of the essential characteristics of the product he wants to order.
The buyer selects one or more products from the various categories offered on the ATP website : rough-casting machine, spraying machines, compressors, individual protection, various tools, etc. The supplies submitted by ATP are valid while stocks last. For the products that are not stored in its warehouse, the supplies submitted by ATP are valid, subject to availability in the factories partners (suppliers).
ATP reserves the right to change the product set particularly in the light of the constraints linked to its suppliers. The photographs, diagrams and descriptions of the products offered for sale are indicatives and do not bind the seller. If a supplier modifies a product, the graphical representation of it can not engage the responsibility of the seller or even affect the validity of the sale. The time given on each product file give information on the availability of this product knowing that:
- in stock, shipped under 24/48/72 hours: our computer system automatically manages this satut when articles are physically in stock. Your order is prepared and shipped under 24/48/72 hours (excluding Saturdays, Sundays and bank holidays). But it is possible that between the time of your order and the validation of your payment, all products in stock had been sold. Indeed, the articles are assigned by our computer system online by credit card or the receipt of your transfer or your check if you choose one of these modes of payment. Thus a credit card payment realized immediately after the confirmation of your order will be the best guarantee to get the items in stock at the time of order.
- Available in 3 to 9 days, 5 to 10 days, 8 to 12 days and 10 to 20 days: the product will be available from our supplier and stocked by ATP within the period indicated (excluding Saturdays, Sundays and bank holidays). As soon as we receive it, your order will be prepared and shipped under 24/48/72 hours (excluding Saturdays, Sundays and bank holidays).
- Stock shortage: the product is temporarily unavailable from our suppliers.
Be aware! In general, and with the exception of orders against repayment, your order is processed after validation by ATP of your payment when you pay online by credit card or on receipt by ATP of your check or transfer when you chose one of these modes of payment. The indications “in stock” and the availability time may vary between the time of your order and the time of the validation of your payment by credit card or the receipt of your transfer or your check. The deadlines for avaibility are also subject to change without notice at the initiative of the supplier. So the signs “in stock” and the availability time applying to your order will be those prevailing at the time of approval of your credit card payment or the time of receipt of your transfer or your check.
Temporary or permanent unavailability of the products from our suppliers : in case of permanent unavailability, we are committed to submitting subtitute articles or reimburse you the missing items, without delay and no later than within 30 days in accordance with the clauses of the section L121-20-3 of the consumer code. In case of temporary unavailability, we inform you of the date on which the product is available again. You then have the option of maintaining your order with these new deadlines or cancel. In the latter case, we are committed to repay the missing items without delay and no later than within 30 days in accordance with the clauses of the section L121-20-3 of the consumer code. For reasons of availability, an order can be shipped in several times.

    4.3 Order

Any order requires a commitment without restriction or reservation with these general sales conditions. From the moment the buyer has registered his order by clicking on the icon "validate your order," he is deemed to have accepted knowingly and without reservation these general sales conditions, prices, volumes and quantity of products offered for sale and ordered.

The order from the buyer must be confirmed by ATP, by email, post or fax. The sale will be considered final after ATP will have send the buyer its order’s confirmation and cashed the full price. ATP recommends the buyer to keep this information on a paper document or on the computer.

5.    Payment

The payment of the full price must be made by the buyer when ordering. At no time, the payments will be considered as deposits.
The receipt of the total amount of the order will be carried out by ATP at the time of validation of the order or if paid by check when it is received.
In the context of specific commercial deal, ATP may propose a payment in three instalments  without charge by credit card.
In the case of a payment in three instalments without charge by credit card, the detail of the redemption dates is communicated to the customer during the validation of the order.
In the event of prepayment of the order before the end of redemption dates, the outstanding amount left will be reduced. It is up to the buyer to verify that his card is compatible with this offer. The blue Ecard do not work within the framework of this offer.
In this case the failure of a single term to an end due immediately report the full price regardless of the previously agreed terms. All orders must be paid in euros.
To set his order, the buyer has all the means of payment specified in the purchase order : credit card (credit card, Eucard, Mastercard, Visa), check and transfer.
The buyer assures ATP that he has the necessary authorization to use the method of payment he chooses, while saving the purchase order.
ATP reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of nonpayment of any amount that would be payable by the purchaser.
Penalties of an amount equal to the interest rate increased by five points apply automatically to  outstanding payments at the end of a period of ten days after the invoice date or as soon as we get a notification of the rejection of banking payment for any other means of payment. Delivery of any new order may be suspended in case of default of payment of a previous order, and notwithstanding the provisions hereof.
ATP reserves the right to ask for a photocopy of the buyer’s identity card for any payment by credit card. As part of the fight against fraud on the Internet,  information about your command can be sent to any third party for checking.

    5.1 Order by online secure credit card

Once you set your order online you are directed to secure servers of our bank of “Société Marseillaise de Crédit” that takes care of your credit card payment. Your credit card information is encrypted and therefore would never pass in clear on the internet. Furthermore they are not passed on us.
Your order will automatically be suspended and you will be notified in the event that the concerned banking centers will have refused to give their consent.

    5.2 Order by bank check or postal check

You can choose this mean of payment at the time of your order. Your order is recorded and you will receive confirmation by e-mail. Register your order number (shown in the confirmation e-mail you receive after registering your command) on the back of your settlement and sent the whole dated, signed and made out to: AZUR TECHNICAL PROJECTION - 26 bd fuon santa - 06340 La Trinité.
For the first command, in order to speed up the processing of your order, add to your sending the copy of both sides of an ID card and particulars of one’s bank account (otherwise, your order will only be processed after banking payment within 10 to 15 days).
After recording your order, you have 10 days, including delivery times, to send us your check for payment. After that time your order is automatically canceled.
Your order is processed after receiving and cashing your check, you automatically receive an e-mail confirming the receipt of your payment.
N.B. : ATP only accepts checks made out in euros from a bank where the agency is located on the territory french exclusively.

    5.3 Bank transfer

    5.4 Credit card by phone

You call us (see contact page), we record your order and your credit card number and date of validation. We will never ask your PIN number.

6.    Choice of the products

The buyer, who has taken informations about the products marketed by ATP and their features, has under his sole responsibility and according to his needs - that he has previously determined before any order - his choice focused on the product which is subject of his order. However, the buyer being the only one to know the materials he has at it’s disposal and which he uses, he is the only one to know if the ordered products are in accordance with those he uses.
ATP provides the purchaser to assist in the selection and installation of equipment a technical hot line phone 04 93 20 34 51 from Monday to Friday 8am to 12pm and from 13am to 17.30pm.
It belongs exclusively to the buyer if he does not consider himself competent enough to ask for any advice.

7.    Shipping and receipt

7.1    General rules

The products will be delivered to the address indicated by the buyer on the order in metropolitan France and Corsica.
You should know that the orders will not be processed for shipping addresses containing only a P.O.  box.
The buyer may require to get the bill to the billing address and not the delivery address by selecting the option provided for this purpose on the order form.
If all the products are not available ATP might have to split orders, and the items will be sent in the first instance and the balance of the order will be sent when all other items will be available.
ATP offers its customers to be delivered by messenger service or by carrier. The large items can only be delivered by carrier.
If the procedures outlined below are not respected, no claim of the buyer will be accepted.
Express deliveries can be considered. For this type of shipment please contact us by phone or by mail to provide you with the cost of this service (carriage undertaken by DHL and TNT).

    7.2 Shipping features of Colissimo Expert 48 to 72 hours

The buyer is delivered to the address indicated on the purchase by the messenger service within 72 hours after the order (excluding weekends and bank holidays) and sign a delivery slip of acknowledgment receipt. In case of absence the deliverer will come with the package two times. We recommend to provide a phone number to make an appointment.
The buyer is required to verify in the presence of the deliveryman  the state of the packaging of the goods and its contents when he is delivered.
You are required to check the condition of the goods at the reception. In case of damage you must accurately mention your reservations on the delivery slip and repeat it to the carrier by recorded letter with acknowledgment of receipt within 3 days after delivery in accordance with the provisions of the section L.133-3 of the consumer code.
You must also inform us by letter with acknowledgment of receipt of all damage caused by transport within 8 days after the receipt. No claims will be accepted in the event of non-compliance with these formalities. We can not under any circumstances be held liable for delays in delivery of postal services.

7.3    Shipping features by carrier 4 to 8 days

The buyer is delivered to his home by the delivery man of the transport company and sign a receipt.
We recommend to provide a phone number to make an appointment. In case of absence, the buyer or the recipient of the product receives notice of passage of the carrier, which enables him to contact the carrier to agree on another day of delivery, the second delivery is free.
You are required to check the condition of the goods at the reception. In case of damage you must accurately mention your reservations on the delivery slip and repeat it to the carrier by recorded letter with acknowledgment of receipt within 3 days after delivery in accordance with the provisions of the section L.133-3 of the consumer code.
You must also inform us by letter with acknowledgment of receipt of all damage caused by transport within 8 days after the receipt. No claims will be accepted in the event of non-compliance with these formalities.

7.4    Delivery time

The average delivery times when the order leaves the ATP warehouse are :
-    Colissimo : 48 to 72 hours.
-    By carrier with appointments : 4 to 8 days.
These deadlines are given at the start from ATP warehouse, knowing that the time management of the order can go up to 20 days depending on the ATP suppliers.
These deadlines are given for information only.
Without delivery to the expiration of this period, the buyer will be able to cancel his order. The amounts paid by the buyer will then be returned to him without delay, to the exclusion of any other compensation.
In case of delay in delivery compared with the initial date, the buyer must notify in writing (mail, fax, telephone) with ATP to improve the quality of service that may be offered and to allow ATP to conduct a survey on the carrier.

A survey on the carrier can last up to 21 working days. If during this time, the product is found, it will be immadiately redirected to the delivery point designated in the order form.
On the other hand, if the product is not found at the end of that 21 days of investigation, ATP will proceed at his own expense to a new shipment of the products ordered by the buyer.
On the assumption that the ordered product would no more be available, we will apply in accordance with the clauses quoted in the Article 8. In the case of an exchange of a product delivery costs will be borne by the consumer.

7.5    : Quality or compliance problems

When delivering a product that does not match the order (defective or non-compliant), the purchaser must
make his claim within a period of 7 days from the signing of the delivery slip.
Claims should be sent by recorded letter with acknowledgment of receipt at the address given in paragraph 2 hereof, and shall include :
-    detail of the buyer.
-    the product’s references
-    the grounds for the claim.
The return of goods should be made within seven  working days from the remit of a return number by the customer of ATP.
If the procedures outlined below are not respected, ATP will not carry out any exchange or refund of the ordered products.
Any product for exchange or refund must be returned to ATP in its condition and original packaging and contain the whole product and its accessories.
The shipping costs are borne by the buyer. You are free to choose the means of sending and subscribe or not insurance in the event of loss, theft or destruction of your package. We will not  support any of these charges and can not be held responsible for the non-receipt of your package.
Any risk connected with the return of the product is borne by the buyer.
Without compliance with the procedure outlined above and with the delivery time, the buyer will be not able to make any claim for non-compliance or obvious defect of the goods delivered, the goods are then deemed to comply and free from any defects.

    8 Products avaibility

In the event of unavaibility of the ordered product, ATP will inform the buyer at the earliest.
In accordance with the provisions of the section L121.20.3 of the Consumer Code, ATP in this case could provide a product with the same quality and price. In any case, the ordered products will be delivered within a maximum period of thirty days to the day following the one on which the buyer has registered his order subject to the full payment of the price.
If ATP fails to exercise this option, the buyer will be refunded without delay and no later than thirty days for the amount he paid.

    9 Retraction right

In accordance with the section L 121-16 of the Consumer Code, the buyer has a period of seven clear days from the date of receipt to return at his own expense the ordered products for reimbursement.
The goods must be returned to ATP in a perfect state of resale, in their original state (packaging, accessories, instructions...), duly sealed and accompanied by the invoice for the purchase. Furthermore if the product contains a guarantee form or any other document to be completed, it should not be filled so that the buyer can exercise his right to withdraw.
Any product which is incomplete, damaged, used, or whose original packaging has been damaged, will not be refunded or exchanged.
The exercise of the right of withdrawal will be chosen by the purchaser :
- either a refund in cash, by transfer on the credit card used during the initial order or if this is impossible by check.
- or the awarding of a purchase order, under the conditions set out in paragraph 10 below.

    10. General terms of repayment

Subject to any special provisions quoted in paragraph 9 above, any repayment at the expense of ATP will be made in the form of a purchase order to be deducted on our website.
In all cases, ATP will inform, in the award of this purchase order by fax or e-mail, of :
-    its validity period
-    whether or not the buyer will be able to request a refund
-    its amount.
If the purchase order does not state the contrary, during its validity period, the customer may request on a simple call to the customer service to change this purchace order into reimbursement.
This refund will be held  first by transfer on the credit card used for the initial order or, if that is impossible by check.
When not using the whole purchase order, the remainder will remain available to the client under the same conditions as the original have.
A purchase order will be deemed to be used in case of partial use or even refund request.
By using this purchase order, the consumer agrees on their honor not to make any protest or opposition to his bank or otherwise, to the transaction covered by the refund, and is urged not to do so within one year after the use of the purchase order.
The consumer acknowledges that he is aware that any breach of that duty would expose him to the return of the amount improperly received, without prejudice to the damages that might be claimed by ATP.

    11. Property right

ATP retains full ownership of the sold products until the receipt of the payment, fees and taxes. During the period between the delivery and the transfer of ownership, the risk of loss, theft or destruction shall be borne by the buyer.
If the buyer fail his payment obligations, the seller can require the immediate return of goods delivered to the costs and risks of the purchaser.

    12. Guarantee

12.1 Some products sold have a manufacturer's warranty which the general conditions vary from one supplier to another. The general conditions and the guarantee validity are available on the web site of  ATP. The purchaser will be deemed to have read and accepted it.
If the noticee is not included with the product, and upon the request of the, consumer, ATP will send the notice in french or a link to have access to it.
Any return of the product under the warranty shall be subject to prior approval of ATP. With this aim in view, the buyer will contact the customer service of ATP. No returns will be accepted without prior authorization of ATP.
If the product is recognized as defective, ATP will transmit to the buyer a return number of the product. This return number, essential and determining condition, is valid for seven days from its transmission by ATP to the buyer. After this period, the buyer should renew its request, using the procedure described above.
The defective product must be returned in its original packaging, including the whole product and its accessories, and must be sent with the legible return number of the product provided by ATP and the product serial number.
Any product which is incomplete, damaged and / or whose original packaging has been damaged, will not be returned or exchanged under the warranty.
All costs and risks associated with the return of the product shall be borne by the buyer. The product  under warranty will be either exchanged or repaired according to the manufacturer.

12.2 ATP does assure the buyer, for hidden defects that might affect the delivered products, that the defective products will be replaced as well as the parts rendering it unfit for use, which may not be considered by the purchaser as responsible for possible consequences that these latent defects might entail.

12.3 In any event, the guarantees do not cover :
-    the replacement of consumables.
-    unusual and non-conforming use of the products.
-    the damages covered by a specific mention in the product data sheets. (We particualarly recommand that you read this before buying any product.)
-    the defects and their consequences due to the intervention of the buyer or of a repairer not registered by ATP.
-    the defects and their consequences associated with the use that is inconsistent with the purpose for which the product is intended.
-    the products which are the subject of a contrat for specific assistance and maintenance.

13. Responsibility

The products sold by ATP are conform the the French legislation.
ATP will not be liable for breach of contract in the event of stock shortage or unavailability of the product, disruption or total or total strike including transport services and/or email.
ATP could not be held responsible for all indirect damages that may arise from the purchase of products. ATP will not be responsible for any loss of data or files.  It is for the buyer to make all the necessary safeguards.
The total or partial inability to use the products, partly  because of an incompatibility of the equipment can not engage the responsibility of ATP or give rise to any compensation or reimbursement.
The AZUR TECHNIQUE PROJECTION.fr website also contains informations from third parties and links to other websites. AZUR TECHNIQUE PROJECTION.fr will under no circumstances be liable for damages arising from the use of, access to, or inability to use this third parties information, nor to the content of other websites.

    14. Partial non validity

If one or more provisions of these general sale conditions  are held to be invalid or declared as such pursuant to a statute, regulation or as a result of a final decision of a court, the other provisions shall remain all their force and scope.   

    15. No renunciation

The fact that one party does not rely on a failure by the other party to any of the obligations set out in these terms and conditions of sale, shall not be interpreted in the future as a waiver of the obligation in question.

    16. Applicable law

The sales of ATP’s products are subject to French law.

    17. Computer and freedom

The information collected by ATP in any order from the buyer are necessary for the management of its order by ATP and its trading partners. According to the Computer and Freedom Act No. 78-17 of 6 January 1978, the buyer has a right of access, rectification, opposition and withdrawal to the data relating to him by applying to ATP. (Article 34 of the Act of January 6,1978)
Through ATP, the buyer may receive commercial proposals from other agencies or companies, or to be informed of ATP offers. If the buyer does not wish to receive these proposals, he may inform ATP by mail to Azur Technique Projection, 26 bd fuon santa – 06340 La Trinité, or by email at atp@azurproj.com.
